AUSSIE SURFSAP™ PRODUCT WARNING, ASSUMPTION OF RISK, LIMITATION OF LIABILITY, AND TERMS OF USE
IMPORTANT: PLEASE READ CAREFULLY BEFORE USING THIS PRODUCT.
By purchasing, possessing, applying, or using Aussie SurfSAP™ (“Product”), you acknowledge that you have read, understood, and agree to these Terms of Use, Warnings, and Safety Notices.
Aussie SurfSAP™ is designed to improve traction between a user and a surfboard or similar sporting surface. The Product is intended solely for recreational sporting use.
The Product:
• Is not a flotation device.
• Is not safety equipment.
• Does not prevent accidents or injuries.
• Does not guarantee traction, grip, control, stability, or performance.
• Does not eliminate the risks associated with surfing, paddling, swimming, or water sports.
Surfing, paddleboarding, bodyboarding, skimboarding, and other water sports are inherently dangerous activities that may result in serious injury, paralysis, drowning, death, property damage, or other losses.
Hazards may include, without limitation:
• Waves, currents, tides, rip currents, and changing weather conditions.
• Collisions with surfboards, fins, reefs, rocks, docks, boats, or other persons.
• Equipment failure.
• Slipping, falling, loss of footing, or loss of control.
• Marine life and environmental hazards.
• Physical exertion, exhaustion, dehydration, and medical emergencies.
Users voluntarily assume all risks associated with participation in such activities, whether known or unknown, foreseeable or unforeseeable.
Users are solely responsible for:
• Determining whether conditions are safe for use.
• Using appropriate judgment and skill.
• Following all applicable laws, regulations, and local safety requirements.
• Inspecting equipment before use.
• Using appropriate protective and safety equipment where warranted.
• Discontinuing use if the Product appears damaged, contaminated, or unsuitable for the intended application.
Users should not rely upon the Product as a substitute for skill, training, supervision, proper equipment maintenance, or safe surfing practices.
Traction performance may vary depending upon environmental conditions, board materials, water temperature, contamination, wear, application methods, and user technique.
No representation or warranty is made that the Product will perform under all conditions or prevent slipping, falls, loss of control, injury, or property damage.
The Product may contain ingredients that can cause skin irritation, allergic reactions, or other adverse effects in certain individuals.
Before use:
• Review all product labeling and instructions.
• Discontinue use immediately if irritation, rash, discomfort, or other adverse reactions occur.
• Seek medical attention if necessary.
Users assume responsibility for determining whether the Product is suitable for their individual use.
The Product may leave residue, discoloration, markings, or surface effects on surfboards, equipment, clothing, vehicles, flooring, furniture, or other property.
Users are responsible for testing the Product on a small area before broader application.
To the maximum extent permitted by applicable law, Aussie SurfSAP™ shall not be responsible for damage resulting from improper application, misuse, removal, cleaning methods, or use on surfaces for which the Product was not intended.
Aussie SurfSAP™ warrants only that the Product will be free from manufacturing defects in materials and workmanship at the time of sale.
Except as expressly stated herein, the Product is provided “AS IS” and “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED.
This limited warranty does not cover damage caused by misuse, abuse, alteration, improper storage, accidents, normal wear and tear, environmental conditions, or failure to follow instructions.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUSSIE SURFSAP™, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, DISTRIBUTORS, RETAILERS, AGENTS, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE PURCHASE OR USE OF THE PRODUCT.
Nothing in these Terms shall exclude or limit liability where such exclusion is prohibited by applicable law, including liability arising from willful misconduct, gross negligence, or other non-waivable legal obligations.
By using the Product, you acknowledge and agree that:
• Participation in surfing and related activities involves inherent risks.
• Such risks cannot be eliminated through the use of this Product.
• You voluntarily and knowingly assume all risks associated with use of the Product and participation in related activities.
Dispose of unused Product, containers, and packaging in accordance with applicable local laws and recycling requirements.
Do not intentionally release Product into waterways, storm drains, or environmentally sensitive areas.
Use of the Aussie SurfSAP™ website is subject to additional website terms and conditions, which may be revised periodically. Continued use of the website constitutes acceptance of any updated terms.
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
To the extent permitted by law, these Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict-of-law principles.
